Intellectual property ("IP") is a multi-faceted area of the law designed to foster creativity and imagination. Because IP rights initially develop from an intangible creation, members of the public frequently misunderstand the purpose of IP protection and enforcement. In sum, the law requires that IP owners monitor and prosecute unauthorized uses of their IP. If our clients do not take action as required by law, they can be stripped of their valuable IP rights, along with the substantial goodwill and recognition associated with their IP.
Our clients have invested considerable resources to develop their IP and market their brands to consumers. As General Counsel, it is my duty to ensure that any unauthorized uses of that IP are halted. As can be expected, opposing parties often disagree on how the law should be applied. Nevertheless, the legal conclusions of our clients are always derived from a thorough evaluation of state and federal law. And, while our clients are obligated to vigorously protect their IP, they also understand the need to consider the particular circumstances of each case. For this reason, every matter is handled on an individual basis.
